Facilitative mediation focuses on dialogue and compromise, with the mediator guiding discussion but not offering opinions. In many cases, that approach works well.
But when parties are deeply divided—or when legal risk is driving the impasse—facilitative mediation can simply prolong stalemate.
Evaluative mediation addresses that problem directly. In an evaluative model, the mediator offers a candid, experience-based assessment of how a family court judicial officer, especially in Hennepin or Ramsey County, is likely to view the dispute. The goal is not to pressure settlement, but to ground negotiations in courtroom reality.
For many clients, that clarity is what finally allows productive movement.
Private SENE and FENE as Alternatives to Stalled Mediation
In family law cases, private Social Early Neutral Evaluation (SENE) and Financial Early Neutral Evaluation (FENE) offer structured alternatives when mediation alone is no longer effective.
SENE focuses on custody and parenting-time issues, providing parents with feedback aligned with Minnesota law and local court practices. FENE addresses financial matters such as income, support, and property division.
By receiving early, neutral input on how a court is likely to analyze the facts, parties are often able to reassess positions and resolve cases without prolonged litigation.
